(1) These General Terms and Conditions (hereinafter "GTC") apply to all contracts concluded between

(hereinafter "Provider")
and the customer (hereinafter "Customer") via the online shop at www.3dob.com.
(2) The version of the GTC valid at the time of contract conclusion shall apply.
(3) Deviating terms and conditions of the Customer shall not be recognized unless the Provider expressly agrees to their validity in writing.
(1) The Provider sells digital 3D print templates (STL files and comparable file formats) for download through the online shop.
(2) The product descriptions in the online shop do not constitute a legally binding offer but serve as an invitation for the Customer to submit a binding offer.
(1) The Customer can select products from the Provider's range and add them to a virtual shopping cart by clicking "Add to Cart".
(2) By clicking the "Place Order" button (or similar designation), the Customer submits a binding offer to purchase the products in the shopping cart.
(3) The Provider confirms receipt of the order by email (order confirmation). This concludes the purchase contract.
(4) The contract text is stored by the Provider and sent to the Customer together with the GTC by email after conclusion of the contract.
(1) All prices are final prices and include statutory value-added tax (where applicable). Any additional costs are indicated separately in the respective product description.
(2) Payment is made via the payment methods offered in the online shop (e.g., credit card, PayPal). Payment processing is handled by our e-commerce service provider Shopify.
(3) The purchase price is due immediately upon conclusion of the contract.
(1) Digital products are made available immediately after receipt of payment by enabling the download.
(2) After payment has been received, the Customer will receive an email with a download link or access to the purchased files in their customer account.
(3) The Provider guarantees the availability of the download for at least 30 days after the purchase date. The Customer is advised to download the files promptly and save them locally.
(1) Upon full payment of the purchase price, the Provider grants the Customer a simple (non-exclusive), perpetual right of use for the purchased digital products.

Right of Withdrawal
You have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period is fourteen days from the day of the conclusion of the contract.

by means of a clear declaration (e.g., a letter sent by post or email) of your decision to withdraw from this contract.
Consequences of Withdrawal
If you withdraw from this contract, we shall reimburse you all payments received from you without undue delay and at the latest within fourteen days from the day on which we received the notification of your withdrawal. For this reimbursement, we will use the same means of payment that you used for the original transaction.
Premature Expiry of the Right of Withdrawal
The right of withdrawal expires prematurely if we have begun to execute the contract after you have expressly agreed that we begin executing the contract before the expiry of the withdrawal period and you have confirmed your knowledge that by giving your consent you lose your right of withdrawal upon commencement of the execution of the contract (§ 356(5) BGB). For digital content, the download is considered the beginning of contract execution.
(1) The Provider warrants that the digital products are free from material and legal defects at the time of delivery.
(2) The 3D print templates are created to the best of our knowledge for common FDM/FFF and SLA 3D printers. The actual print result depends on the individual printer settings, material used, and the Customer's printer. Deviations in the print result do not constitute a defect.
(3) In the event of defects in the digital files (e.g., faulty file structure, unprintable files), the Customer is entitled to subsequent performance or replacement delivery. If subsequent performance fails, the Customer may withdraw from the contract or reduce the purchase price.
(4) Warranty claims expire within two years of the provision of the digital product.
(1) The Provider is liable without limitation for intent and gross negligence as well as for damages resulting from injury to life, body, or health.
(2) In cases of slight negligence, the Provider is only liable for breach of essential contractual obligations (cardinal obligations). In these cases, liability is limited to the foreseeable, contract-typical damage.
(3) The above limitations of liability do not apply to claims under the Product Liability Act or guarantees assumed by the Provider.
The processing of personal data is carried out in accordance with our Privacy Policy, available at www.3dob.com/en/datenschutz, which forms an integral part of these GTC.

(2) We are not willing or obliged to participate in dispute resolution proceedings before a consumer arbitration board.
(1) The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).
(2) For consumers, this choice of law only applies insofar as the protection afforded by mandatory provisions of the law of the state in which the consumer has their habitual residence is not withdrawn (principle of favorability).
(3) The place of jurisdiction for all disputes arising from this contractual relationship with merchants, legal entities under public law, or special funds under public law is the registered office of the Provider.
Should individual provisions of these GTC be or become invalid, the validity of the remaining provisions shall not be affected. The invalid provision shall be replaced by a valid provision that comes closest to the economic purpose of the invalid provision.
